TERMS AND CONDITIONS

1. Headings and Interpretation

1.1 These terms and conditions (“Terms and Conditions”) govern the terms under which you are using this website and our services (“Services”) made available through it.

1.2 ‘Services’ includes any access to Jafodet Money Transfer Service application(s) available via internet/web access, mobile and smartphones, tablets, or any other technology that allows you to access the Service, which exists now or in the future.

1.3 You agree to be bound by these Terms and Conditions by accessing, registering with, and using the services.

1.4 These Terms and Conditions are written in the English language, and all our services will be carried out in English.

1.5 In the Terms and Conditions, the terms “Jafodet Money Transfer”, “we”, “us”, and “our” refer to Jafodet Money Transfer Ltd, together with its employees, directors, successors, and assigns.

1.6 The terms “you” and “your” refer to you, the person who has registered to use our services for money remittance.

1.7 These Terms and Conditions shall be coming into effect on the date you sign up to use our services and will continue for an indefinite period until terminated by you or us.

2. Transaction information

2.1 A customer is entitled to know the amount that a recipient will receive, the applicable exchange rate estimated delivery time and any document the recipient to provide before receipt of a fund if applicable.

Transaction flow

3.1 Customers to create an account. They will supply the required information and documents.

3.2 Due diligence (Know-Your-Customer) to take place. Documents and information provided to be verified and checks carried out to comply with the Anti-money laundering regulations.

3.3 If verification is successful, customers choose the country that the payment is going to (now, it is Nigeria but with time, other countries, and currencies are to be added).

3.4 The delivery method now is by online bank transfer into the recipients’ accounts (but other modes of payment delivery to be added to give customers choices)

3.5 Customers to enter recipients’ details which will include recipient’s name, name of the recipient’s bank, recipient’s bank account number in the paying country and amount they are sending including fees.

3.6 Customer to make payment through bank transfer into our UK bank account or pay securely with their debit/credit card.

3.7 To check all transfer details provided by customers and effect the transfer within one hour to one working day if there are issues with the paying banks’ network.

3.8 Payment to be confirmed to the customers in the UK and to the recipient in the paying country through SMS and email.

4. Customer Identification

Like other financial institutions, money services providers are required to assist in the fight against money laundering activities and the funding of terrorism by obtaining, verifying, and recording identifying information about all customers. Jafodet Money Transfer may therefore ask you to supply us with personal identifying information relating to you, the Sender, and any Payee.

5. Verification and Checks

5.1. We will obtain a copy of proof of identity and a copy of a proof of address from our customers. We will verify your residential address and personal details to confirm your identity. This is done to confirm your identity. We may also need to verify the identity of a Sender or Payee in the same way. All information provided by you will be treated securely and strictly in accordance with all applicable laws.

5.2. We may ask you for additional information or ask you to take steps to confirm ownership of your accounts, Payment Instruments, or email address; or indirectly, for example by verifying your information against third party databases or through other sources.

5.3. Proof of identity
The primary form of identification must bear a photograph and signature:

  • full UK or foreign passport that has the Machine-readable zone
  • full UK or foreign photo card driving licence
  • photo card national identity card that has the Machine-readable zone

The passport, driving licence or national identity card must be valid, up to date and be signed by the holder.

5.4. Proof of address

The second form of identification must confirm the individual’s permanent residential address:

  • Full UK photocard driving licence bearing residential address (if not already used as your proof of identity)
  • UK or foreign bank credit card or bank statement (dated within the last three months and not printed from the internet)
  • UK mortgage statement (dated within the last 12 months and not printed from the internet)
  • UK council tax bill (for the current year)
  • letter/bill from utility company (less than 3 months old, except for water bills, which must relate to the current charging period). The letter you receive must confirm you receive a service from the company and cannot be printed from the internet. Mobile phone bills are not accepted
  • UK TV licence letter or Direct Debit schedule (less than 12 months old). This should confirm your name, address, and the existence of a TV licence

6. Transaction refund

6.1. Refund of the amount paid, and cancellation of the Money Transfer will be made upon written request of the Sender if payment to the Receiver has not yet been made at the time the request is processed by Jafodet Money Transfer.

6.2. Where we cannot proceed with a customer’s transaction due to a delay or for whatever reason, the customer will have a right to receive a refund or arrange with us to carry out the transaction at a later time after the cause of the delay has been resolved.

6.3. Refunds will be made within 45 days of receipt of a valid written request from the Sender.

7. Customers’ obligations and responsibilities

7.1. In consideration of the use of the Service, the customer will have to pay a prescribed fee before your transaction can be done.

7.2. You are to comply with the terms and conditions of business as stated in this document.

7.3. You must provide the required information or document before or during the time that your transaction is being carried out.

7.4. You are not allowed to transfer money, use a debit, or credit card that does not belong to you to make payment to us.

7.5. Third-party payment or transaction is not allowed. These include payments from a business account, from a spouse, children or relative bank account are not allowed. Where payment is received from any of these sources, the payment will be returned to the account that the money came from.

8. Confidentiality/ Privacy

8.1. Jafodet is a regulated money transfer business. It is authorised by the Financial Conduct Authority and our activities are approved by the Her Majesty Revenues & Customs. We are required to obtain, verify, and record information about our customers. During business, we may have to obtain your data and/or documents.

8.2. Personal information obtained from you will be processed and securely stored as required by the law.

8.3. Information obtained from a customer will be treated as strictly confidential except the customer permits us to divulge such information or we are required by law to do so.

9. Collection of Information

9.1. If you create an account at the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.

9.2. Providing false contact information of any kind may result in the termination of your account.

9.3. You must immediately notify us of any unauthorised uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

9.4. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill.

9.5. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

10. Collection of personal information

10.1 During the online registration process for a transaction, certain personal information will be obtained from customers. Jafodet Money Transfer seeks to limit the amount and type of information collected from customers to that which is necessary and relevant to our everyday business needs. These needs include:

  • processing our customer’s money transfer transaction(s);
  • verify customer’s identity;
  • managing fraud and security risks;
  • responding to customer’s inquiries and requests for technical support; and
  • complying with legal and regulatory requirements.

10.2 We may also use your information to communicate special offers, new products or features or invite you to participate in surveys or opinion-gathering devices. If you do not wish to receive such communications, you may “opt-out” at the time Jafodet Money Transfer collects information or at any time thereafter by simply contacting us at 07533129331 or support@jafodet.co.uk

11. Managing personal information

11.1 You can access, add to, update and delete certain Personal Information about you. The information you can view, update, and delete may change as the Website or Services change.

11.2 A copy of the updated information may be retained in our records for as long as your account is active or as needed to provide you Services. Some information may remain in our private records after you delete such information from your account. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.

12. Data breach

12.1 If the security of the Website has been compromised or users’ Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities.

12.2 In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the user as a result of the breach or if notice is otherwise required by law. When we do, we will post a notice on the Website, send you an email.

13. Termination or suspension of service

13.1. We reserve the right to terminate or suspend our services to a customer where:

13.1.1. Offering our services to a customer will be in breach of our business terms and conditions

13.1.2. We noticed that a customer is sending money to us from a third-party account without authorisation or the transaction is deemed to be fraudulent or for an illegal or prohibited purpose.

13.1.3. The transaction is perceived to be for a suspicious activity

13.1.4. Inaccurate, incomplete false information is provided by the customer

13.1.5. Customer cannot be reached to confirm the accuracy of information provided

13.1.6. Customer has not provided the required information, or the information provided is discovered to be fraudulent.

14. Notices

12.1. Any notice required to be given under these Terms and Conditions shall be in writing and signed by the person giving it and may be delivered personally or by electronic means or by first class post to our business address in respect of each of the parties or to such other address as may otherwise be notified by either party to the other as being an alternative address for service.

14.2. Any notice so served shall be deemed to be received:

14.2.1. if delivered personally, at the time of delivery.

14.2.2. if sent by facsimile transmission or other electronic means, on the day of transmission provided it is sent during Business Hours on a Business Day and if not on the next Business Day; and

14.2.3. if sent by post, 48 hours after the date of posting.

15. Third-party rights

15.1 For the Contracts (Rights of Third Parties) Act 1999, this Agreement does not and is not intended to give any rights, or any right to enforce any of its provisions, to any person who is not a party to it.

16. Indemnification

16.1 You agree to indemnify and hold Jafodet Money Transfer. and its directors, officers, employees, and agents harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website or Services or any willful misconduct on your part.

17. No Waiver

17.1 Our failure to exercise or enforce any right or provision of the Agreement will not constitute a waiver of such right or provision.

18. Severance

18.1. If any provision of this Terms and Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of this agreement which shall remain in full force and effect.

18.2. If any provision of this Terms and Conditions is so found to be invalid or unenforceable but would be valid or enforceable if some part of the provision were deleted, the provision in question shall apply with such modification(s) as may be necessary to make it valid and enforceable.

19. Termination

19.1. Upon the happening of any of the following events:

19.2. either party is in material breach of its obligations in this Agreement and (in the case of a breach capable of being remedied) has failed to remedy such breach within 30 days of the aggrieved party giving notice in writing specifying such breach and stating that the same is required to be remedied: or

19.3. an order is made or a resolution passed for the winding up of either party (unless such order or resolution be part of a bona fide scheme of reconstruction or reorganisation of such party and the resulting entity agrees to be bound by all the terms and conditions of this Agreement) or an administrator or receiver or administrative receiver is appointed over the whole or part of either party’s assets or undertaking or either party enters into any composition or arrangement (either formal or informal) with its creditors, the aggrieved party may by notice in writing immediately terminate this Agreement.

19.4. The termination of this Agreement howsoever arising shall be without prejudice to the rights and obligations of any party accrued before termination.

20. Governing law and jurisdiction

20.1 This Terms and Conditions and any dispute or claim arising out of or in connection with its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales and you irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.

21. Entire Agreement

21.1 This Agreement contains the entire and only agreement between our organisation and you and supersedes all previous agreements between the parties respecting the subject matter of these Terms and Conditions.

21.2 Each party acknowledges and agrees that in entering into this Terms and Conditions it has not relied on, and shall have no remedy in respect of, any statement, representation, undertaking or warranty, whether oral or in writing, save as is expressly set out in these Terms and Conditions.

22. Right to vary these terms and conditions

22.1 We reserve the right to amend, revise or replace these Terms and Conditions from time to time without any obligations on our part to serve you a notice of such action.

22.2 The Terms and Conditions shall apply to you from the time that you have placed an order for our service all through the period that you remain to be our customer unless you notify us within a reasonable period of time or within seven days of your intention to cancel your order.

23. Acceptance of this policy

23.1 You acknowledge that you have read this Policy and agree to all its terms and conditions. By using the Website or its Services you agree to be bound by this Policy.

23.2 If you do not agree to abide by the terms of this Policy, you are not authorised to use or access the Website and its Services.

24. Complaint procedures

24.1. Your feedback is important to us as it will help us to be able to take corrective measures and improve our service delivery.
